1. Agreement to terms
By using CarShare, you agree to these Terms. CarShare is a peer-to-peer marketplace connecting vehicle owners with renters. We facilitate listings, bookings, payments and disputes but are not the owner or renter of any vehicle.
2. Eligibility
You must be 18 or older, hold a valid South African driver's licence, and complete identity and licence verification before booking or listing a vehicle.
3. Bookings
Bookings are requests unless the host enables Instant Book. A booking is confirmed when the host accepts (or instantly) and payment is authorised. Double bookings are prevented by the platform; confirmed dates block the vehicle's calendar.
4. Payments, deposits & payouts
Renters pay the rental amount, optional delivery/cleaning fees, and a refundable security deposit. CarShare charges a 10% platform commission on the rental amount. Hosts receive payouts net of commission after a completed booking. Deposits are refunded subject to vehicle condition.
5. Platform fee
CarShare retains a platform fee of 10% of the rental amount (excluding deposits and optional fees unless stated). This covers payment processing, insurance facilitation and support.
6. Cancellations
Cancellations are governed by our Cancellation Policy. Hosts and renters may cancel under specified conditions with varying refund outcomes.
7. Vehicle use & responsibilities
Renters must return the vehicle on time, with the agreed fuel level, and are responsible for traffic fines, tolls, and damage during the rental. Mileage limits and overage fees apply as stated in each listing.
8. Insurance & damage
Vehicles may be covered by the host's comprehensive insurance. Damage, accidents and theft must be reported via the in-app claims workflow within 24 hours. Security deposits may be withheld to cover verified damage.
9. Prohibited conduct
No subleasing, illegal activity, misrepresentation, off-platform payment, or abuse of other users. Violations may result in suspension and forfeiture of deposits.
10. Liability
CarShare is not liable for the acts of hosts or renters beyond facilitating the marketplace. Our liability is limited to the platform fees collected on a booking.
11. Governing law
These Terms are governed by the laws of the Republic of South Africa.
